Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you ("User", "you", "your") and ClaimLex Technologies ("ClaimLex", "Company", "we", "us", "our"), governing your access to and use of the ClaimLex platform, websites, mobile and progressive-web applications, application programming interfaces, and all related services (collectively, the "Platform" or "Service").

By registering for, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Acceptable Use Policy, Refund & Cancellation Policy, Cookie Policy and Disclaimer, each of which is incorporated by reference. If you do not agree, you must not use the Platform.

1. Definitions

  • "Content" means all judgments, orders, editorial headnotes, ratio decidendi, catchwords, summaries, citations, metadata, commentary, acts, rules, and other materials made available on the Platform.
  • "Subscription" means a paid or trial plan granting access to gated features for a defined period.
  • "Account" means your registered user profile.
  • "Editorial Content" means value-added material prepared by ClaimLex (headnotes, holdings, catchwords, summaries), as distinct from the verbatim text of an order issued by a court or tribunal.

2. About the Service

ClaimLex is a legal-research platform providing:

  • Indexed decisions of MACT Authorities, Motor Accident Claims Tribunals, High Courts, the Supreme Court of India and Consumer Commissions;
  • Advanced search (keyword, boolean, proximity, semantic and field-specific modes);
  • Editorial headnotes, ratio decidendi, catchwords and case summaries;
  • A national ClaimLex (RLX) citation system and a citator linking related decisions;
  • AI-assisted research features, where enabled and subject to plan limits;
  • A research workspace with bookmarks, notes, alerts and licence-stamped PDFs.

3. Eligibility

You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872. By using the Platform you represent that: (a) all registration information you provide is true, accurate and current; (b) you have a legitimate research purpose; and (c) your use complies with all applicable laws. The Platform is intended for users in India; if you access it from elsewhere, you do so on your own initiative and are responsible for local-law compliance.

4. Account Registration & Security

You are responsible for maintaining the confidentiality of your credentials and for all activity under your Account. You must notify us immediately at security@claimlex.in of any unauthorised use. Device limit: access is licensed for a single active device per Account unless a different limit is expressly granted; concurrent logins beyond your limit may be terminated automatically. Accounts are personal and non-transferable. Credential sharing, seat-sharing, or providing access to non-subscribers is prohibited and may result in suspension without refund.

5. Subscriptions, Trials, Fees & Taxes

  • Plans. Features and limits are set out on the pricing page and may vary by plan. We may modify plan features, limits and pricing prospectively.
  • Trials. A trial (where offered) grants limited-time access; on expiry, gated features are locked until you subscribe.
  • Billing. Fees are payable in advance for the subscription term (monthly or annual) via our payment processor, Razorpay. All fees are stated in Indian Rupees unless otherwise specified.
  • Taxes. Fees are exclusive of applicable Goods and Services Tax (GST) and other taxes, which will be added at the prevailing rate and shown on your invoice.
  • Renewal. Subscriptions may auto-renew where you have opted into recurring billing; you may cancel auto-renewal at any time from your account before the renewal date.
  • Non-payment. We may suspend or downgrade access on failed or overdue payment.

Refunds and cancellations are governed by the Refund & Cancellation Policy.

6. Licence & Permitted Use

Subject to these Terms and payment of applicable fees, ClaimLex grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and Content for your own internal legal research, professional practice, academic or personal reference. You may take reasonable extracts and cite decisions in the ordinary course of legal work.

7. Restrictions

You must not, and must not permit any third party to:

1. Copy, scrape, crawl, harvest, mirror, or systematically download Content, or build a competing database or product from it;

2. Resell, sublicense, rent, lease, or commercially redistribute the Content or access to the Platform;

3. Share, transfer or sell your credentials, or circumvent the device limit, paywall, rate limits, or any technical protection;

4. Reverse engineer, decompile, or attempt to derive source code, models or algorithms;

5. Use automated means (bots, scripts, headless browsers) to access the Platform except via an API expressly licensed to you;

6. Remove, obscure, or alter any proprietary notice, citation stamp, licence stamp, or watermark;

7. Use the Platform to train, fine-tune, or ground any machine-learning or generative-AI model;

8. Introduce malware, attempt to gain unauthorised access, or interfere with the integrity or performance of the Platform;

9. Use the Content or Platform for any unlawful, misleading, defamatory or infringing purpose.

Breach of this Section is a material breach and may result in immediate suspension or termination without refund, in addition to any other remedy available to us.

8. Intellectual Property

The Platform, its software, design, databases, RLX citation system, and all Editorial Content are the intellectual property of ClaimLex and are protected under the Copyright Act, 1957 and other laws. The verbatim text of court and tribunal orders is in the public domain; however, ClaimLex's compilation, arrangement, tagging, editorial treatment, and value-added materials are protected. Nothing in these Terms transfers ownership to you. All rights not expressly granted are reserved. Under Article 4 of EU Directive 2019/790 and applicable law, we expressly reserve rights against text-and-data mining for AI training.

9. AI-Assisted Features

Where enabled, AI features generate summaries, answers and suggestions from the corpus. AI output may be incomplete, outdated, or incorrect ("hallucinated"). It is a starting point for research, not a substitute for reading the primary order or for professional judgment. You are solely responsible for independently verifying any AI-generated result before relying on it. AI features are subject to plan-based usage limits and fair-use throttling.

10. User Content

You may create notes, bookmarks, tags and other materials ("User Content"). You retain ownership of your User Content. You grant ClaimLex a limited licence to host, store, and process it solely to provide the Service. You are responsible for your User Content and must not upload anything unlawful, infringing, or confidential to others without authority.

11. Third-Party Services

The Platform relies on third-party providers (including payment processing by Razorpay, cloud hosting, email delivery, and analytics). Your use of such services may be subject to their terms. We are not responsible for third-party services outside our control.

12. Availability, Changes & Beta Features

We aim for high availability but do not guarantee uninterrupted or error-free service. We may perform maintenance, modify, suspend or discontinue any part of the Platform, and may release beta or experimental features "as is" without warranty. Content coverage grows over time and is not represented to be exhaustive of all decisions of any forum.

13. Disclaimer of Warranties

THE PLATFORM AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ClaimLex IS NOT A LAW FIRM AND DOES NOT PROVIDE LEGAL ADVICE. NO ATTORNEY-CLIENT RELATIONSHIP IS CREATED. Editorial Content is for reference only; the authoritative text is the original order issued by the relevant authority. See the Disclaimer.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ClaimLex AND ITS DIRECTORS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE PLATFORM OR RELIANCE ON ANY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO ClaimLex IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Nothing limits liability that cannot be excluded under applicable law.

15. Indemnity

You agree to indemnify and hold harmless ClaimLex from and against any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or your violation of any law or third-party right.

16. Suspension & Termination

We may suspend or terminate your Account immediately for breach of these Terms, suspected fraud or abuse, non-payment, or as required by law. You may cancel at any time from your account. On termination, your licence ends and you must cease using the Platform; Sections that by their nature should survive (including 7, 8, 13–15, 18–20) survive termination.

17. Changes to these Terms

We may amend these Terms from time to time. Material changes will be notified by email or an in-app notice, and the "Last Updated" date will change. Continued use after changes take effect constitutes acceptance.

18. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to Section 19 (Arbitration), the courts at Mumbai, Maharashtra shall have exclusive jurisdiction.

19. Dispute Resolution & Arbitration

The parties shall first attempt to resolve any dispute amicably by written notice. Failing resolution within thirty (30) days, the dispute shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Mumbai, and the language shall be English. This clause does not prevent either party from seeking urgent interim relief from a competent court.

21. Miscellaneous

  • Entire Agreement. These Terms and the incorporated policies are the entire agreement between you and ClaimLex and supersede prior understandings.
  • Severability. If any provision is held invalid, the remainder continues in effect.
  • Waiver. Failure to enforce a provision is not a waiver.
  • Assignment. You may not assign these Terms; we may assign them to a successor or affiliate.
  • Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
  • Notices. Legal notices to us must be sent to legal@claimlex.in.
